GENERAL CONDITIONSYou agree to use all Santa Fe Hosting services in a manner consistent with all applicable laws, including not using your web site to post any defamatory, threatening, or untrue statement, any gambling activities, or any material that infringes the proprietary rights of another person.
You agree that you (not Santa Fe Hosting) are the author and publisher of and are solely responsible for the content of all material posted to your web site, regardless of the source of that material.
Santa Fe Hosting has no obligation to approve, review, or verify the content of any such material. Customer warrants that it owns all rights to all material it provides to Santa Fe Hosting or posts to its web site, including all copyrights and trademarks.
The web site shall not be used to store pornographic material. Sites containing adult material or xenofobical contents although not necessarily pornographic, are also prohibited.
If Santa Fe Hosting detects violations to this policies, web site account will be terminated for violating our acceptable use policy described here and all fees paid to Santa Fe Hosting become non-refundable.
RESPONSABILITIES, BACKUPS & LIMITATION OF LIABILITYSanta Fe Hosting shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Santa Fe Hosting’s servers going off-line or being unavailable for any reason whatsoever.
Further, Santa Fe Hosting shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Santa Fe Hosting’s servers.
All damages shall be limited to the immediate termination of service.
Full backups are made weekly, and backups of new/changed data made nightly.
No guarantees are made of any kind, either expressed or implies, as to the integrity of these backups.
Backups are made for server restoration purposes only. It is the clients’ responsibility to maintain local copies of their web content any information.
If loss of data occurs due to an error of Santa Fe Hosting, Santa Fe Hosting will attempt to recover the date for no charge to the client.
If data loss occurs due to negligence of client in securing their account or by an action of the client, Santa Fe Hosting will attempt to recover the data from the most recent archive for a U$S 50.00 fee.
USERS KNOWLEDGESSanta Fe Hosting gives by understood that provided services use require a minimun knowledge in language application, protocols and internet related software.
Customer agree to have the needed knowledge to create and maintain their web site.
Customers agree to know than Santa Fe Hosting is not responsabile to teach this knowledge either provide not hosting service related technical support.
SERVICE SUSPENSION OR DENEGATION.Santa Fe Hosting shall be the sole arbiter of what is and is not a violation of these acceptable use policies.
Santa Fe Hosting reserves the right to terminate an account at any time and for any reason that causes harm to any Santa Fe Hosting customers web sites.
Santa Fe Hosting reserves the right to delete all content and files upon termination.
Santa Fe Hosting reserves the right to withhold any pre-paid funds for any site removed for violations of these policies.
Santa Fe Hosting reserves the right to refuse, cancel, or suspend service at our sole discretion.
PERSONAL DATA.The customer is responsible for securing their username/password.
Regular hosting customers, resellers, and their clients agree to provide complete name, address, email address, contact phone number and any other information required by Santa Fe Hosting with any pourpouses.
Also you agree to notify Santa Fe Hosting any personal data changes. Santa Fe Hosting agree that information you provide is protected by law, and will never be shared, selled, or published.
SECURITYThe client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery.
The client is responsible for securing their username/password.
Use of Santa Fe Hosting service requires a certain level of knowledge in the use of Internet languages, protocols, and software.
The customer agrees that he or she has the necessary knowledge to create and maintain their web space.
Customers agree to maintain Santa Fe Hosting informed about any suspicious behavior that could be considered hacking or snooping activities.
Violations of these Policies could cause refuse, cancel, or suspend service.
SPAM, UNSOLICITED OR BULK E-MAIL.These include spamming (sending unsolicited advertising to those with which the customer has no existing business relationship, posting off-topic advertising in newsgroups), spoofing (using a return email address which is not the valid reply address of the sender or sending an email message which does not contain enough information to enable the recipient to identify the party who is really sending the message;
passive spamming (promoting a web site hosted by Santa Fe Hosting by spamming from some other source),
trolling (posting controversial messages in newsgroups to generate responses),
mailbombing (inundating a user with email without any serious intent to correspond),
generating a higher volume of outgoing mail than a normal user (10% or more of available system resources),
and subscribing someone else to an electronic mailing list without that person permission.
A message is considered unsolicited if it is posted in violation of a newsgroup charter or sent to a recipient who has not requested the message.
Making an email address available to the public does not constitute a request to receive messages.
Distribution of mass emailing programs is also prohibited.
All recipients on a mailing list must have personally subscribed.
Mailing lists may not be used to distributed unsolicited email.
Any customer repeatedly mailbombed or that attracts such behavior will be asked to leave.
Santa Fe Hosting reserves the right to determine what constitutes spamming.
Violations of these Policies could cause refuse, cancel, or suspend service.
SCRIPTSAll the customers accounts that use CGI, Perl or any other languaje Scripts in their own cgi-bin folder, must to provide a copy of such script to determine if scripts could cause server malfunctioning.
Santa Fe Hosting reserves the right to remove any script file that could dangerous or attemps damage the server.
Santa Fe Hosting reserves the right to terminate an account at any time and for any reason that causes any usage of twenty percent (20%) or more of our system resources or server down.
Running programs in the background on a Santa Fe Hosting server without Santa Fe Hosting’s prior written authorization, or running chat rooms, Internet Relay Chat, IRC bots, and the like are not acceptable uses of Santa Fe Hosting servers.
BILLING & PRICES.Santa Fe Hosting reserves the rights to change plan prices and/or remove hosting plans.
All changes will be published in the Santa Fe Hosting Web Site.
All web hosting plans billing period have automatical renew.
If you want to cancel your web site, we must receive a request (via fax or e-mail) at least 14 days prior to the start of your next hosting period.
The request must include the web site name, billing and contact information, daytime phone, and fax number.
In addition, the cancellation request must be signed by an officer of the company or by the owner of the domain name.
LACK OF PAYMENT.Santa Fe Hosting, will notify via e-mail with 15(fifteen) days before service renovation date.
In lack of payment cases, three (3) days after Santa Fe Hosting will suspend all the account service, (web, ftp, e-mail, etc).
After 7days Santa Fe Hosting will delete hosting account with all data from the web servers without right to reclamations.
PAYMENT METHODSWe bill in advance, in either monthly for packs, and quarterly for single plans.
We require a 3 month minimum contract and hosting plans automatically renew for the next hosting period unless we receive 14 days advance written notice of cancellation.
Monthly billing is only available for multidomains packs plans.
We accept American Express, Master Card, and Visa cards as well as Western Union issues.
PRIVACYSanta Fe Hosting will not intentionally monitor private electronic mail messages sent or received by its subscribers unless required to do so by law, governmental authority, or when public safety is at stake.
Also, Santa Fe Hosting will keep a restrictive policies about personal information provided by customers.
Santa Fe Hosting reserves the right to sent notifications via e-mail periodicaly to maintain customers up to date of any modifications about hosting plans, pricing and/ or Aceptable use policies. This e-mails must treated by customers as normal e-mail and not as spamming activities.
MODIFICATIONSSanta Fe Hosting reserves the right to change these Policies without prior notice or warning. Non-enforcement of any part of these Policies does not constitute consent.
Violations of these Policies will cause immediate termination of service.
